1. Acceptance of Terms

By accessing and using this barbershop queue management system ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. Your continued use of the Service constitutes acceptance of these terms and any future modifications.

2. Description of Service

The establishment provides a digital queue management system that allows customers to:

Join a virtual queue remotely
Receive SMS notifications about queue status
View estimated wait times
Select preferred services and barbers

This Service is provided as a convenience to enhance your barbershop experience and does not constitute a reservation, appointment, or guarantee of service.

3. User Responsibilities

By using this Service, you agree to:

Provide accurate and truthful information
Use a valid phone number for SMS notifications
Arrive at the barbershop in a timely manner when notified
Treat staff and other customers with respect
Not abuse, spam, or misuse the queue system
Not attempt to circumvent queue position or system rules

4. Queue and Wait Time Disclaimer

All wait time estimates are approximate and provided for informational purposes only. Actual wait times may vary significantly due to factors including but not limited to:

Service complexity and duration variability
Staff availability and breaks
Customer delays or no-shows
Technical issues or system errors
Unexpected circumstances beyond our control

We make no guarantees regarding wait times, queue positions, or service availability. Joining the queue does not guarantee service on any particular day or time.

5. No-Show Policy

Customers who fail to arrive within the notification window may be marked as a no-show and removed from the queue. Repeated no-shows may result in temporary or permanent suspension from using the queue management system.

6. SMS Notifications

By providing your phone number, you consent to receive SMS notifications related to your queue status. Message and data rates may apply depending on your mobile carrier. We are not responsible for SMS delivery delays or failures caused by carrier issues, network problems, or invalid phone numbers.

7. Service Availability

The Service is provided on an "as available" basis. We do not guarantee uninterrupted access to the queue management system. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE BARBERSHOP, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA
DAMAGES ARISING FROM DELAYS OR INACCURATE WAIT TIME ESTIMATES
DAMAGES ARISING FROM MISSED APPOINTMENTS OR SERVICE UNAVAILABILITY
DAMAGES ARISING FROM SMS NOTIFICATION FAILURES OR DELAYS
DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR INFORMATION
DAMAGES ARISING FROM INTERRUPTION OR CESSATION OF THE SERVICE
DAMAGES ARISING FROM ANY OTHER MATTER RELATING TO THE SERVICE

THIS LIMITATION OF LIABILITY SHALL APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH THE CLAIM IS BASED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS SERVICE, OR TEN CANADIAN DOLLARS ($10 CAD), WHICHEVER IS LESS.

10. Assumption of Risk

You expressly acknowledge and agree that your use of this Service is at your sole risk. You assume full responsibility for any consequences arising from your use of the queue management system, including but not limited to reliance on wait time estimates, queue position information, or SMS notifications.

11. Indemnification

You agree to indemnify, defend, and hold harmless the barbershop, its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

Your use of and access to the Service
Your violation of any term of these Terms of Service
Your violation of any third party right, including any privacy or intellectual property right
Any claim that your use of the Service caused damage to a third party

This indemnification obligation will survive the termination of these Terms and your use of the Service.

12. Release of Claims

You hereby release and forever discharge the barbershop and its owners, operators, employees, agents, and affiliates from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether known or unknown, arising out of or in any way connected with your use of the Service.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and the establishment regarding the use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

15. Waiver

The failure of the establishment to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Calgary, Alberta, Canada for the resolution of any disputes arising out of or relating to these Terms or your use of the Service.

17. Class Action Waiver

Any proceedings to resolve or litigate any dispute shall be conducted solely on an individual basis. You agree that you will not seek to have any dispute heard as a class action, representative action, collective action, or private attorney general action.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
